Article 1 - General Provisions
The institutional website www.mariehelenedetaillac.com (hereinafter referred to as the Site) is published by the company ILU - S.A.R.L with a share capital of fifteen thousand euros, registered in the Paris Trade and Companies Register under number B 453 307 621, intra-community VAT number FR 444 533 076 21 and whose registered office is located at 8, rue de Tournon 75006 Paris, France.

Access to sales via the Europe Online Shop is exclusively reserved for Customers, as defined below, residing in the countries listed below:
Austria, Belgium, France, Germany, Greece, Italy, Luxembourg, Monaco, Netherlands, Portugal, Spain.
A "Customer" is considered to be any consumer who is a natural person of full age and who acquires the Items for his or her exclusive personal use.
The GCS govern the relationship between the "Customer" (hereinafter, "Customer" or "Customers" or "You") and ILU S.A.R.L (together, hereinafter, "Parties") for the purchase of the Items offered by the Site (hereinafter the "Items") sold via the Europe Online Shop and/or by email. The language for the conclusion of the contract is French.
Article 2 - Identification of the offeror
The Marie-Hélène de Taillac Articles offered in the Europe online shop are sold by the company ILU - S.A.R.L with a share capital of 15,000 euros, registered with the Paris Trade and Companies Register under number B 453 307 621, intra-community VAT number FR 444 533 076 21 and whose registered office is located at 8, rue de Tournon 75006 Paris, France.
Article 3 - Content of the offer and availability
The Items available for sale on the Europe Online Shop (according to the terms and conditions defined in Article 4 below) are those presented in the "e-shop" chapter. ILU S.A.R.L reserves the right to change the Items offered on the Europe Online Shop at any time and without notice.
Our offers of Articles and prices are valid as long as they are visible on the Europe Online Shop and within the limit of available stock.
Information on the availability of materials is given to you in the material master record. Errors or changes may exceptionally exist, in particular in the case of simultaneous orders of the same Material by several Customers. In the event of unavailability of the Item after you have placed your order, we will inform You by e-mail or by telephone as soon as possible, offering You the option of either ordering another Item presented on the Europe Online Shop as a replacement, or of cancelling your order. If You choose to cancel your order, You will be refunded within a maximum period of 30 days if your bank account has been debited.
ILU S.A.R.L cannot be held responsible in the event of stock shortage or unavailability of the Articles ordered.
Article 4 - Prices and Payment
4.1 Prices
The price of the Items is expressed on the Europe Online Shop in euros (€) and includes all taxes, excluding delivery costs. The final amount of your order will include delivery costs.
ILU S.A.R.L reserves the right to modify at any time, without notice, the prices of the products offered on the Europe Online Shop. The Items are invoiced on the basis of the prices displayed on the Europe Online Shop at the time of the validation of your order, subject to the availability of the Items ordered at that time.
ILU S.A.R.L. constantly checks that all the prices indicated on the Europe Online Shop are correct, but cannot guarantee the absolute absence of errors. If an error in the price of an item should occur, ILU S.A.R.L shall give the Customer the opportunity to reconfirm the purchase of the item at the correct price or to cancel the order. If ILU S.A.R.L is unable to contact the Customer, the order shall be considered cancelled.
4.2 Terms of payment
a) The Customer may pay for his order
- by the following credit cards: Carte Bleue, Visa, MasterCard, American Express.
All orders must be paid immediately after validation. All payments made on Our boutique line Europe are secured using the SSL 3 D SECURE
process. The transaction will only be debited to the Customer's credit card after verification of the Customer's data, receipt of the debit authorisation from the credit card company used by the Customer, confirmation of the availability of the Article by ILU S.A.R.L and therefore once the order is ready to be dispatched.
c) In the event of unavailability of certain Items ordered, only the price relating to the available Items will be debited.
4.3 Transfer of Ownership
The transfer of ownership of the Article purchased on the Europe Online Shop to the Customer occurs after full payment of the price. The transfer of the risks of loss and damage to the Article takes place upon delivery of the Article.
Article 5 - Terms and conditions of order
5.1 - Ordering
Once the order has been completed, the Customer must validate his order by pressing the "Validate" button, after having accepted the General Terms and Conditions of Sale. If the Customer already has a customer account, he will then be proposed to proceed to the payment of his order. Otherwise, he will be offered to create a customer account before proceeding to the payment of his order.
If the Customer needs to correct possible errors in the insertion of data, he may follow the appropriate modification procedure contained in the Europe Online Shop before sending his order. ILU S.A.R.L. shall send the Customer a confirmation of receipt of his order as well as a summary of his order by e-mail.
5.2 - Validation of the order
No modification or cancellation may be made once the order has been paid for, except as provided for in these GTC.
ILU S.A.R.L. may in certain cases ask the Customer to provide additional information via a form to be filled in. This document must be returned by email accompanied by a copy of the Customer's identity document and a copy of the means of payment used to pay for the order.
The Customer shall check the contents of the confirmation of his order as soon as possible and immediately notify ILU S.A.R.L of any errors or omissions. The data recorded by the Europe Online Shop shall constitute proof of all transactions between ILU S.A.R.L and the Customer. In the event of a dispute between ILU S.A.R.L and one of its Customers concerning a transaction carried out on the Online Shop Europe, the data recorded by ILU S.A.R.L shall be considered as irrefutable proof of the content of the transaction. For any purchase, the invoice will be available by going to the "My Account" section accessible from the Europe Online Shop.
In accordance with the provisions of article L.134-2 of the French Consumer Code, when an order is for an amount equal to or greater than one hundred and twenty (120) euros, ILU S.A.R.L keeps the written document which establishes the contract concluded between ILU S.A.R.L and a Customer by electronic means for a period running from the conclusion of the contract or from the date of delivery of the goods for a period of 10 years. You then have the right to access this document at any time by simple request to Customer Service at the address below: [email protected] after providing proof of your identity.
Article 6. Delivery
For security reasons, Items purchased on the Europe Online Shop will be delivered in plain packaging. The signature of an adult aged 18 or over will be required at the time of delivery.
Do not forget to report any damaged packages upon receipt.
6.1 Delivery zones
Items purchased on the Europe Online Shop can only be delivered to the countries mentioned in Article 1 above. Any address outside these countries will be refused during the ordering process. For security reasons, no order for which a hotel address, cedex address or P.O. box address is provided can be processed.

6.2 Terms and conditions and shipping costs
For France and for the European countries mentioned in article 1 above, the Articles will be delivered by Colissimo La Poste or by DHL Express. Orders will be shipped from Tuesday to Friday, except on public holidays.
The delivery of the goods must be made in the presence of an adult person, the deliveryman presents himself and has the recipient sign for the receipt of the package.
In the event of absence, a calling card will be left in the addressee's mailbox.
At the time of delivery, You must check the conformity of the Articles and indicate, on the delivery note of DHL Express, in the form of handwritten reserves accompanied by your signature, any anomalies noted (open package, damaged, damaged Article, missing ...).

In case of non-conformity of the Articles or if they do not give You satisfaction, You can return them and ask for an exchange or a refund under the conditions provided for in Article 7 below.
6.3 Delivery times
Delivery times depend on the Articles ordered and the country of the order and will be indicated to You when You place your order. The maximum delivery time is fifteen (15) days.
In the event that ILU S.A.R.L is unable to deliver the Items ordered due to sudden unavailability, even temporary, of the latter, it shall inform the Customer of this without delay and within thirty (30) days at the latest by e-mail.
The sums already paid by the Customer will be refunded to him as soon as possible and at the latest within thirty (30) days of payment of the sums he has paid.
Article 7 - Right of withdrawal - Returns - Exchanges - Refunds
7. 1 Conditions
ILU S.A.R.L. wishes to guarantee the total satisfaction of the Customer.
The Customer will benefit from a legal right of withdrawal which he may exercise for fourteen (14) days following receipt of the Article ordered, without having to justify his reasons or pay any penalties.
Exchanges are also possible within fourteen (14) days.
The period runs from the reception of the Marie-Hélène de Taillac products. When the fourteen (14) day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended to the first following working day.
The products must be returned to the following address: ILU S.A.R.L 8, rue de Tournon, 75006 Paris.
However, ILU S.A.R.L. reserves the right to refuse the return of Articles which do not comply with the conditions set out in this Article.
We will reimburse you for Marie-Hélène de Taillac products returned at the invoiced price, according to their method of payment, within a maximum period of thirty (30) days following the date on which you exercised your right of retraction.
Only you will be able to exercise this right of retraction. This right may not be exercised by the recipient of your order.
7.2 Procedure
To make the return process easier for you, please follow the steps mentioned below.
a) First of all, please call the Customer Relations Department (01.44.27.07.08) or send an e-mail to [email protected] to indicate your wish to return the product.
b) Prepare your package which will contain the product, all its accessories, and other documents, in the original product box and packaging.
c) Seal the packaging and affix the return label provided by us.
d) Depending on the case, go to a Post Office to drop off your package or contact DHL Express to arrange for the collection of your package.
The Customer or Recipient of the Gift, as the case may be, must keep proof of the return shipment, and ILU S.A.R.L shall not be liable in the event that the Customer is unable to provide proof.
Upon receipt of returned goods, ILU S.A.R.L will check that the returned product complies with these General Terms and Conditions of Sale. Only the goods received by ILU S.A.R.L. shall give the right to a refund or an exchange, as the case may be.
7. 3 Conditions for returning a product
Products sold on the Europe Online Shop must be returned new and unused.
The customer must also return the original box and packaging of Marie-Hélène de Taillac products, with all accessories, if applicable, with all protective materials and labels in place, as well as the labels and stickers attached to the products. Failure to do so will give ILU S.A.R.L the right to either withhold the corresponding value of the refund made to the Customer, or to refuse the product returned by the Customer.
Items returned incomplete, damaged, deteriorated, soiled will not be refunded in full.
Marie-Hélène de Taillac personalized products cannot be returned, exchanged or reimbursed.
Sizing is considered customization.
All returns will be subject by ILU S.A.R.L to a rigorous Quality Control to ensure that the returned products comply with quality requirements. If the returned product meets the Quality Control standards, ILU S.A.R.L will proceed to refund or exchange, as the case may be.
7.4 Exchange or refund
If the Customer wishes a refund, the amount of the returned Article will be refunded within thirty (30) days by crediting the Customer's bank account.
If the Customer wishes to exchange the Article, ILU S.A.R.L. shall bear the shipping costs of the first exchange. In the case of a second exchange, the shipping costs shall be borne by the Customer.
In both cases, ILU S.A.R.L shall send an e-mail specifying the value of the returned product, the price of the item against which the original product was changed and the amount of the difference to be paid by the Customer or the one the Customer is entitled to receive.
Article 8- Legal guarantees
Items sold on the Europe Online Shop are subject to the legal warranty conditions provided for in Articles L.211-4, L.211-5 and L.211 - 12 of the Consumer Code, as well as Articles 1641 and 1648 of the Civil Code.
As a Customer, You may have the same rights under the applicable national legislation governing the sale of consumer goods; these rights are not affected by these General Terms and Conditions of Sale.

Article 10 - Errors, inaccuracies
ILU S.A.R.L. constantly updates the information published on the Europe Online Shop. However, it is impossible to guarantee that the Europe Online Shop is free of errors. The Europe Online Shop may contain errors, inaccuracies or omissions, some of which may concern the price and availability of the Item and the description of the Item itself. ILU S.A.R.L reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also reserves the right to change or update information at any time without notice.
Article 11 - Applicable law and competent court
The present General Terms and Conditions of Sale are subject to French law. In the event of any difficulty arising during the ordering or delivery of the Articles, the Customer will have the possibility, before any legal action, to seek an amicable solution, in particular with the help of a consumer association or any other counsel of his choice.
Any dispute that may arise from the interpretation or execution of these general terms and conditions of sale and its consequences shall be subject to the exclusive jurisdiction of the French courts.
